These Terms of Service ("Terms") govern your access to and use of the TraceLever platform, website, and related services (the "Service"), provided by Hacktics ("TraceLever," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
The short version: you can use TraceLever to trace your ad spend to your revenue. Your data stays yours. Agencies can use it for their clients. We provide the Service "as is" and our liability is limited. Use it lawfully.
1. Who Can Use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
2. Accounts
You're responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us or others.
3. The Service
TraceLever connects your advertising accounts and your business or CRM tools to trace the customer journey from ad click to revenue, and to report attribution metrics back to you. Features, integrations, and availability may change over time as we improve the Service. We may add, modify, or remove functionality, and we'll aim to give reasonable notice of material changes.
4. Connected Accounts and Third-Party Services
The Service works by connecting to third-party platforms — including GoHighLevel, Google Ads, Meta, AccuLynx, Jobber, Square, and HubSpot. By connecting an account, you authorize TraceLever to access and process data from that platform as needed to provide the Service. Your use of those platforms remains governed by their own terms, and we're not responsible for their availability, accuracy, or actions. If a third-party platform changes or restricts its access, some features may be affected.
5. Data Ownership
You own your data. As between you and TraceLever, all data you provide or that we collect and process on your behalf — including ad data, tracking data, form submissions, contact and revenue records, and the attribution results derived from them — belongs to you ("Customer Data").
You grant TraceLever a limited, non-exclusive license to host, process, and use Customer Data solely to provide, secure, and improve the Service for you, and as described in our Privacy Policy. We may use aggregated and de-identified data that does not identify you or any individual to operate and improve the Service.
You're responsible for having the rights and permissions needed to provide Customer Data to us and to connect the accounts you connect, including any required notices to or consent from the individuals whose data is processed.
6. Agency Use
If you're an agency, you may use the Service to manage advertising attribution for your clients' accounts, provided you have authorization from each client to access and process their data. You are responsible for your clients' compliance with these Terms in connection with your use, for the relationship and agreements between you and your clients, and for ensuring appropriate permissions and privacy notices are in place. As between you and TraceLever, you remain responsible for the accounts and data you manage through the Service.
7. Acceptable Use
You agree not to:
• Use the Service for any unlawful, fraudulent, or harmful purpose;
• Connect accounts or upload data you don't have the right to use;
• Track individuals in violation of applicable privacy laws or platform policies;
• Attempt to access, probe, or disrupt the Service, its security, or other users' data;
• Reverse engineer, copy, resell, or create a competing product from the Service except as permitted by law;
• Use the Service to send spam or to violate the terms of any connected platform.
8. Fees and Payment
Paid plans are billed at the rates and intervals shown at signup or in your order. Fees are due in advance and, except where required by law, are non-refundable. We may change pricing with reasonable notice; changes take effect at your next billing cycle. Failure to pay may result in suspension or termination of the Service.
9. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by TraceLever and Hacktics and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms. All rights not expressly granted are reserved.
10. Disclaimers
The Service is provided "as is" and "as available." Attribution is inherently estimative: it depends on data from third-party platforms, browser and device behavior, and visitor actions, and may be incomplete or imperfect. We do not warrant that the Service will be uninterrupted, error-free, or that attribution results will be fully accurate or complete. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Business decisions you make based on the Service are your responsibility.
11. Limitation of Liability
To the fullest extent permitted by law, TraceLever and Hacktics will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless TraceLever and Hacktics from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, your connected accounts, your clients' data (if you're an agency), or your violation of these Terms or applicable law.
13. Term and Termination
These Terms apply for as long as you use the Service. You may stop using and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or create legal or security risk. On termination, your right to use the Service ends. We will make Customer Data available for export for a reasonable period and may then delete it in the ordinary course, consistent with our Privacy Policy and legal obligations.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in [COUNTY/STATE] for any dispute not subject to other agreed resolution.
